Introduction
We are Panacaea Boutique SA (hereafter "we", "us" or "our"), a Swiss company registered under the nr. CHE-113.442.603 and we operate our website. This Policy explains how we collect your personal data, whether as a registered user or as a guest, from your interactions with us on our websites, mobile apps, and digital tools (collectively, the ‘’Digital Platforms”) and from third parties; how we use it; how we protect it; and your rights as our consumer.
Digital Platforms means online and offline sources websites, mobile sites, applications or social media pages (hereafter "the Digital Platforms").
Our products are sold through different business partners. Unless otherwise indicated at the time that you provide your personal data, this Policy does not apply to any personal data that our authorized business partners independently collect from you.
- Data collection
We do not ‘sell’ your personal information about our consumers. We do not make available or provide consumer’s names, phone numbers, addresses, email addresses, or other personal information to third parties in exchange for money. However, we do share or make available personal information that we collect with third parties to provide you with personalized advertising from us and analytics. For example, we share personal information with third parties such as social media platforms to optimize our marketing campaigns, display ads for us, and measure the effectiveness of those ads on such platforms. We collect your data to fulfil our contract or take steps linked to a contract. Our legitimate interest in strengthening client loyalty by providing personalized services based on client’s interests and preferences.
What kind of personal information we collect and for what purposes?
The personal information that we collect about a specific person will depend on, for example, our relationship or interaction with that person. We collect personal information that you provide us, from your engagement with our brand sites and platforms, advertising, media; from third parties who have your permission to share it with us; and automatically collected (such as through cookies and other similar technologies).
This Policy covers our data collection activities, including personal data we collect through our various channels online (such as websites, apps, and social networks) and offline (such as at points of sale, customer service and events). It also explains how we collect information through the use of cookies and related technologies on our websites and apps. Please note that we combine personal data that we collect via one channel (e.g. Panacaea website) with personal data we collect via another channel (e.g. a Panacaea point of sale or event-in-store) which can include combining personal data that were originally collected by different Panacaea in different countries in order to provide you a personalized service adapted to your preferences and interests. If we change the way we handle your personal data, we will update this Policy and notify you or seek your consent as and when appropriate, usually by placing an updated Policy on our websites. If we make significant changes that materially alter our privacy practices, we may also notify you by other type of communications, such as sending an email prior to the changes taking effect. We may also provide you with additional information when we collect personal data where we feel it would be helpful to provide relevant and timely information.
When do we share your personal information?
We share personal information with third parties (vendors, agencies, marketing applications and partners and businesses) that help us run our Digital Platforms, our business, and retail our products. We do not ‘’sell’’ the personal information about our consumers. We share or make available your personal information to third parties to provide you with personalized advertising and analytics. For example, we share personal information with third parties such as social media platforms to optimize our marketing campaigns, display ads for us, and measure the effectiveness of those ads on our digital platforms. These companies use personal information to improve their own products and optimize their own ad targeting systems. This type of activity is considered a ‘share’ or ‘use’ of personal information for targeted advertising and are subject to a right of opt-out.
The following data will be shared in accordance with our Privacy Policy :
- Personal data provided by you, by creating a Panacaea account, signing up to our loyalty or other client programs, or by providing data about yourself to us in our Digital Platforms or Points of Sale.
- Identifiers: including your name, home and mobile phone number, IP address, home address, country of residence, email address, social media account, signature, or other similar identifiers.
- Preferences: including product preferences, preferred language, communication channels, and skincare wishes.
- Personal life information: name, age, signature (including electronic signature), contact details such as telephone number and address, driver’s license or state ID number, lifestyle, life habits, hobbies, interests and reactions to marketing campaigns, professional or employment-related personal information. Other information considered Personal Information.
- Characteristics of Protected Classifications: including your age, gender, and national origin.
- Physical characteristics or descriptions
- information automatically collected and processed from us or from your use of our Digital Platforms, your visits or interaction with our online adverts.
- Commercial Information: including your purchase history and interactions with us (such as products bought and quantity, order details, visits to our Digital Platforms or points of sale).
- Social Media Information. If you accept targeting cookies from social networks on the Digital Platforms, or if you use the share button to share our content through those platforms, those third parties may collect and process your data in order to provide you with personalized advertising.
- Online activity: including, but not limited to, browsing history, search history, and information regarding your interaction with our websites or third-parties websites such as social media, applications or advertisements and other technical information or personal information shared by the service provider you are using;
- Network information: about your visit to our Digital Platforms, including the URL clickstream to, through and from our Digital Platforms (including date and time); products you viewed or searched for, the content (and any ads) that you view or interact with, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page, technical information about your browser, device type, and operating system.
- Inferences: including your information and interactions with us to enrich and supplement such profile, your preferences, aptitudes, attitudes, characteristics, trends.
- Geolocation Data: including physical location of you or your device (e.g., IP address or zip code). Precise information about your location if you allow us (or a third party who provides it to us) to collect it. Your location information when you visit our Digital Platforms in order to direct you to the appropriate domain (internet location) or when you request location services provided by us, or to provide more precise location-based content.
The following data will not be shared in accordance with our Privacy Policy :
- Billing Information. This includes your delivery address and payment details. We reserve the right to request additional evidence or proof of billing information where, in our reasonable opinion, this is necessary. Please note we do not keep your payment card details on file. We use a third-party data controller to process payment details;
- Correspondence and communication between us and you.
- Website registration: including your username and password.
- Information or content you provide to us including photographs, videos, reviews, questions, survey response and comments.
- Information necessary to fight counterfeiting and infringements of Panacaea’s intellectual property rights. This includes identification and contact details and any other information and documents related to counterfeit and infringing activities.
- Information necessary to manage Panacaea’s distribution system in order to protect Panacaea brand and identify unauthorized resellers. This includes profiling activities on your purchase behaviors.
- Audio, electronic, visual, thermal, olfactory, or similar information: This includes CCTV security camera data (such as your image) when you visit one of our boutiques that has a CCTV camera used to view and record individuals 24 hours per day, 7 days per week for security reasons. This data is not sold or shared.
Your consent (if required by local applicable laws)
- To enrich your Panacaea profile. This includes supplementing your Panacaea profile with information related to your activities on social media and your browsing activity across different websites and devices through the use of cookies and similar technologies by us or third parties (such as social media - WhatsApp, Facebook, Instagram, Youtube, Tiktok or other online platforms). The privacy and cookie policies of these third parties will apply to their use of your personal data.
- To allow you to participate in the interactive features of the website and to place cookies and related technologies
- To ask your opinion or to take part in market research or client studies.
- To provide you with personalized advertising both on our Digital Platforms and other selected partner websites.
- To create campaigns that enable us to reach people who are likely to be interested in our products because they are similar to you. We may use cookies or other technologies that may rely on third parties, such as WhatsApp, Facebook, Instagram, Youtube, Tiktok or other online platforms and other online platforms. ou may have provided your consent to those third parties and their respective privacy policies would apply.
- To monitor your account to prevent, investigate and/or report fraud, terrorism, misrepresentation, security incidents or crime in accordance with applicable law.
- Comply with a legal obligation
- To investigate any complaints or answer any inquiry received from you or from others about our Digital Platforms, Points of Sale or our products and services.
- To monitor the use of our Digital Platforms and Points of Sale and use your information to help us monitor, improve and protect our products, brand, content, services and Digital Platforms and Points of Sale, both online and offline and your experiences with us including via research and demographic studies; analytics and data cleansing and measuring the effectiveness of our advertising campaigns.
- To use personal data in connection with legal claims, compliance, regulatory and investigative purposes as necessary (including disclosure of such personal data in connection with legal process or litigation) or to enforce or apply our Terms of Use or any other agreements, our selective distribution system or to protect the rights, property, or safety of Panacaea, our customers, or others.
- In response to requests by government or law enforcement authorities conducting an investigation.
Our interests to protect our company and the Panacaea brand and defend ourselves from legal claims, comply with a legal obligation, for our internal corporate reporting purposes.
Profiling
In order to ensure data accuracy and to offer you a better and personalized client experience no matter where and how you interact with us, we link or combine the information that we collect from the different sources and channels outlined above to provide personalized services, content, targeted communications and advertising and for analytics purposes. All the information that Panacaea processes about you (including information provided by you or collected by us or by third parties) will be linked to your Panacaea profile. We also may draw inferences from any of your information and interactions with us to enrich and supplement such profile, reflecting your preferences, characteristics, trends, predispositions, aptitudes and attitudes. We will use your identification data such as email address or phone number to link the information to your profile. The above may also apply when checking out as a guest on our Digital Platforms and if you are a prospective client.
You must not provide to us information about anyone else unless you have their permission to do so.
Personal Information we observe or collect automatically
We collect directly, or by third parties, your information to observe about you on our Digital Platforms. We or third-party companies (e.g., Google) collect personal information automatically when you use or visit our Digital Platforms, install and use our mobile apps, view our advertisements, interact with our emails or other communications, or use our products and services. This personal information is collected through a variety of technologies, such as cookies, flash cookies, JavaScript tags, software development kits, application program interfaces, web beacons, and other technologies described below. Information collected via automated means include identifiers (e.g., IP address, device ID, cookie ID, mobile advertising identifier), geolocation, commercial information, and internet or network activity (e.g., clickstream data, such as browsing and search history, other interactions with Our Sites). We combine personal information collected automatically with personal information we already have about you.
How long we retain your personal information?
We will retain personal information about you for so long as your account is active as we need to provide you services, as long as you engage with us, and as necessary to comply with our legal and/or regulatory obligations, to resolve disputes, to manage our rights, and to enforce our agreements. We will keep your personal information as long as necessary to fight counterfeiting and infringements of Panacaea’s intellectual property rights, such as identification and contact details and any other information and documents related to counterfeit and infringing activities. This information may be collected directly by Panacaea or one of its vendors on its behalf and provided to Panacaea by external parties; Furthermore we will retain your personal information to manage Panacaea’s selective distribution system in order to protect Panacaea brand and identify unauthorized resellers. This will include profiling activities on client’s purchase behaviors (such as products bought, quantities, frequency and other transaction details) based on objective criteria but it does not imply automated decision making. Some of this information is collected using cookies and related technologies.
We do not control certain privacy settings and preferences maintained by our social media partners like Facebook and TikTok etc. If you wish to make changes to those settings and preferences, you may do so by visiting the settings page of the appropriate social media site.
Information collected and processed from third party sources
We share personal information with third parties (vendors, agencies, and businesses) that help us run our websites, our business, social networks data – the use of our Digital Platforms does not generally involve processing data in relation to third party media platforms and/or social networks, such as Facebook or Instagram. However, if you accept the targeting cookies or if you use the share button to share our content through those platforms, those third parties may collect and process your data in order to provide you with personalized advertising. Location information when you visit our Digital Platforms in order to direct you to the appropriate domain (internet location).
When you pay for your products, we may get information from our payment processing service provider who will carry out credit and antifraud checks on you and the payment method you provide in order to verify your identity, to validate your credit or debit card, to obtain an initial credit or debit card authorization and/or to authorize individual purchases.
Other Analytics Services
We are using a certain analytics service, such as Google Analytics, to gather information about our site visits or mobile app usage. We also use Google Analytics Advertising Features to share information with Google about your use of our websites to allow us to deliver relevant and personalized advertising or content to you on other websites. We have enabled the following Google Analytics Advertising Features: Google Analytics Demographic and Interest Reporting, Google Display Network Impression Reporting, Remarketing with Google Analytics, and integrated services that require Google Analytics to collect data for advertising purposes, including collecting data via marketing cookies and identifiers. How long we keep your Personal Information?
We will keep the personal information about you for so long as your account is active, you engage with us, as needed to provide you services, and as necessary to comply with our legal and/or regulatory obligations, to resolve disputes, to manage our rights, and to enforce our agreements. We do not control certain privacy settings and preferences maintained by our social media partners like Facebook and Twitter. Purchase and order management
We collect and use personal information when you purchase products or services from us, whether on our websites or otherwise. This includes payment details to complete a purchase.
On our digital platforms, we collect and use personal information you publicly post on social media platforms or when you mention us on social media platforms.
Promotions: we collect personal information during your participation in a competition, game, contest, promotional offer, sample request, or response to a survey.
User Generated Content
When you submit content (such as images or rating and reviews on one of our websites or you agree to allow us to re-use content you posted on social media). We may ask you to participate in a survey or general research. If you chose to take part in these, you may provide personal information in connection with your response.
Use of our websites and services
If you use a chat feature on our digital platforms, we (and a third party provider of chat software who provides us with services) collect personal information you share during the interaction, interactions with our chat tool, and transcripts of the chat conversation. You may use other features of our Digital Platforms that may ask you to grant permission to access the camera or other features of your computer or mobile device.
We may collect and store your image, for example, if you use social sharing to send your image to a friend or post it online or if you save it to your profile. We may collect, capture, possess, store, or obtain the picture you provide, and data obtained or created from your picture (including the automated recognition of various facial landmarks that might qualify as biometric data, biometric information, or a biometric identifier under various laws).
How do we disclose and transfer your personal data ?
We operate globally and may transfer your personal information to, third party service providers or to authorized retail partners in locations around the world, including countries that do not provide an adequate level of data protection. We want you to have the best service and client experience no matter how and where you interact with us, whether in our Digital Platforms all over the world. For this purpose, we may have to share your personal information outside the country where you have first shared it with us, always for the purposes described in this Policy and where we are satisfied with the levels of protection and security implemented by the third party in compliance with applicable laws. This sharing of your personal information is necessary to enable us to offer you a global and personalized client experience and services. Please note that the third parties listed above may be located in a country outside of your country of residence, including outside the European Economic Area, United Kingdom or Switzerland.
We also share information with third parties including social media and search engine partners.
We aggregate your personal data with the information of other customers, creating a dataset of information about the usage of our digital platforms, purchase of our products, and other general, grouped information about our customers. Although this dataset is aggregated and anonymized, meaning it cannot directly identify you as an individual, it provides a valuable insight into the use of our Digital Platforms and we will share it with select third parties.
We also transfer information about you to ad technology providers and our social media and search engine partners (including Meta, Google and Twitter) so that they may recognize your devices and deliver interest-based content and advertisements. The information can include your name, postal address, email, device ID, or other identifier in encrypted form. The providers often process the information in hashed or de-identified form. Additional Purposes:

For these purposes, we may use any categories of personal information collected by us. We may also use information you provide to us for other purposes as disclosed at the time you provide your information or otherwise with your consent.
Notice of third-party plugins that control collection of personal data: we use third party services on our Digital Platforms where the third party directly controls the collection of personal data on our behalf. These services are targeted marketing and advertising services. You have the right to opt-out of the "sale" or "sharing" of your personal data as detailed in our Privacy Policy.
We have collected and use any personal information for other purposes reasonably required for day-to-day operations, such as accounting, financial reporting, business analytics, collecting payments due and owing to us, operational and strategic business planning, and expense management.
